Commission and Fees:

If you choose to implement an insurance policy through us, we are paid commission by the insurer. Please see the tables below for a comprehensive list of how much different providers pay us.

*These commissions are for the Ultimate Health & Ultimate Health max products only. We will send you the commission for the other products if we recommend them separately.

For KiwiSaver:

I may refer you to other service providers, including Generate KiwiSaver and Generate Managed Funds. Therefore, I need to disclose that if you decide to invest with Generate, I will receive a commission of $50-$300 for KiwiSaver and an ongoing payment of 0.125% on funds invested for Managed Funds accounts. This fee is paid to me by Generate from the revenue they receive from the fees you pay.

For General Insurance:

I may refer you to other service providers, including Tower Insurance and Howden. Therefore, I need to disclose that if you decide to take a policy with Tower Insurance, I will receive a commission of 10- 15% upfront commission (paid as earned) and 10% – 15% renewal for the life of the policy.

On occasion, product providers may treat us to an occasional coffee or tea. Due to the volume of business that we do with some companies (most notably Fidelity Life) they may provide us with complimentary attendance at conferences or management retreats which may have a value of up to $5000 p.a.

One-off Fees for Insurance:

We do not expect to charge any one-off fees relating to any financial advice provided to our clients.

However, if you cancel or materially reduce your insurance policy premiums within the first 2 years of issue, I may have to repay commission to the insurer which is called a clawback fee. If this happens, we may charge you for up to 10 hours of work at $250 per hour plus GST for the work done in advising and implementing the cover for you.

We will inform you of the exact amount if the situation arises. We do not aim to charge this fee unnecessarily.

Conflicts of Interest & Complaints:

From time to time, product providers may also reward us for the overall business we provide to them. They may give us tickets to sports events, lunch, coffee tea or other incentives) management retreats which may have a value of up to $5000 p.a.)

To ensure that our advisers prioritise our clients’ interests above their own, we follow an advice process that ensures our recommendations are made on the basis of each client’s goals and circumstances (unless it is a limited advice). All our advisers undergo annual training about how to manage conflicts of interest. We undertake a compliance audit, and a review of our compliance programme annually by our internal compliance team and reputable external compliance firm.

Maxwell Financial Services Ltd maintains registers to track any conflicts of interests and any gifts or incentives the company or staff might receive. During our annual Adviser Business Statement review (company process review) these registers and patterns are noted and appropriate training is provided in addition to normal practices where necessary.

What should you do if you are unhappy with something?

If you have a problem, concern, or complaint about any part of our service or your product performance, please contact us in the first instance by either email info@maxwellinsurance.co.nz or phone +64 21 592 786 so that we may try to fix the problem.

We will contact you within 3 business days and aim to resolve your complaint within 10 working days.

When we receive a complaint, we will consider it following our internal complaints process:

We will consider your complaint and let you know how we intend to resolve it.

  • We may need to contact you to get further information about your complaint.
  • We aim to resolve complaints within 10 working days of receiving them.
  • If we can’t, we will contact you within that time to let you know that we need more time to consider your complaint.
  • We will contact you by phone or email to let you know whether we can resolve your complaint and how we propose to do so.

If we can’t resolve your complaint, or you are not satisfied with the way we propose to do so, you can contact Financial Services Complaints Ltd (FSCL) – A Financial Ombudsman Service.

FSCL is our independent external ombudsman and dispute resolution service that has been approved by the Minister of Consumer Affairs under the Financial Service Providers (Registration and Dispute Resolution) Act 2008.

Their service will cost you nothing as we pay for it, and it can help us resolve any disagreements.

Maxwell financial services are committed to protecting your privacy. This privacy statement outlines how we collect, store, use and share your personal information.

By submitting your details to us, you consent to the use of your personal information in accordance with this privacy statement.

What information do we collect?

We may collect personal information about you, either directly from you or from other parties and we may generate information about you when we carry out our business.

  • Professional compliance advisers and auditors

We will only share your personal information with third parties where it is necessary to help us do what we collected your information for, where it is required by law, or where you give us authority to. We will not share unnecessary information with these 3rd parties, and where reasonably possible, we will keep you anonymous.

Sometimes third parties provide your information to us. We expect all such parties to have your consent before doing so.

How do we collect your information?

In most cases we collect personal information directly from you when you:

  • Call, text, WhatsApp or email us
  • Talk to an agent, employee, contractor, or director of ours
  • Take out products or make a claim through us
  • Fill out our website contact form

Where do we store it?

We use third party cloud service providers to store and process the information we collect. We use google drive cloud servers located in Australia, United States and the Asia – Pacific region.

We use Zoom and Marloo as our AI notetakers. Your information may be stored or processed outside New Zealand, including in countries such as the United States and Australia. We ensure that our cloud-based service providers are subject to appropriate security and information handling arrangements and that the information stored or processed by them remains subject to confidentiality obligations.

How do we protect it?

We take every reasonable step to protect your personal information. We have independent cybersecurity specialists who monitor and administer our cybersecurity.

We require the third parties to adhere to our strict confidentiality requirements for handling personal information, and we seek to ensure that they comply with the Privacy Act 2020.

We may temporarily hold hard copies of your personal information in our offices. We always seek to scan digital copies as soon as we can and destroy the hard copies.

A link to another site doesn’t mean we support all the content on that site. We’re not responsible for the content of websites we link to or the privacy practices of those websites and we have no control over the activities of those websites.

We recommend checking the terms and condition and privacy policies of any websites before disclosing any personal information.

What are my rights?

You do not have to provide information to us. If you choose not to provide necessary personal information when requested, we maybe be unable to provide certain information or services to you.

You have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong.
